Elsa PD: Man admits to making video threatening local teacher

David Martinez

Elsa police this week arrested a 31-year-old Weslaco man accused of threatening an Edcouch-Elsa High School teacher, according to a probable cause affidavit.

David Martinez, a 2006 EEHS graduate, admitted to police he posted a video on Facebook with a gun on his lap with the caption, “just let tio know,” the affidavit states. He was arrested Wednesday on a terroristic threat charge.

Martinez, according to the affidavit, was reacting to his brother’s Facebook post from earlier that day, which was critical of an educator at EEHS. Before posting his video, Martinez commented on that post.

The teacher told police “she has been having problems with (the brother) from an incident that occurred in May involving his daughter,” the affidavit states.

“He posted those comments and video because his brother … posted a picture of his niece with injuries from an incident that occurred in school and that it made him mad and he loves her and will do anything to protect her,” Martinez told police, according to the affidavit. “He knows he ‘(expletive) up and that’s why he deleted the post because he knew someone would take it the wrong way.’”

Martinez’s brother told police that Martinez commented on his post: “I bet if Tio Red has lunch with you the bullying would stop,” the affidavit read.

And the accuser told police that Martinez commented “tell me who it is and I’ll take care of it.”

A terroristic threat intended to interrupt a public place is a class A misdemeanor. If convicted, Martinez faces up to a year imprisonment and up to a $4,000 fine.
